2. PRIVACY AND DATA USE
2.1 Privacy Policy Incorporation: Your use of the Ownia Collection website and services is also governed by our separate Privacy Policy. By agreeing to these Terms, you acknowledge that you have read and agree to the terms of the Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy details how we collect, use, protect, and disclose your personal information.
2.2 Data Collection and Use: You consent to Ownia Collection collecting and using technical, operational, and location data gathered during your use of the Site and services, including interactions with AI Booking Agents, to facilitate travel services and improve our platform.
4.1 Agency Status: Ownia Collection (“Ownia”) is a travel agency and curated marketplace. We act as an agent for the User (the “Guest”) to facilitate reservations for accommodations, transportation, and other travel-related services at “Member Hotels” that are evaluated against sustainability criteria aligned with the United Nations Sustainable Development Goals (SDGs) as well as general service standards. While we facilitate the booking and may handle payment processing, the ultimate “Travel Service” (the stay, transportation, or travel-related services) is performed by the Member Hotel or other third-parties.
4.2 Booking Channels: These Terms apply to all bookings initiated through any Ownia channel, including but not limited to the Ownia Website, AI Booking Agents, Telephone, Email, or Messaging apps. By confirming a booking through any of these channels, you authorize Ownia to act as your representative in securing reservations.
4.3 Independent Service Providers: Although Ownia vets Member Hotels against our 12 Impact Pillars and general service standards, these hotels are independent contractors. Member Hotels are not employees, partners, or joint ventures of Ownia. Ownia is not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of any such Member Hotel.
5. GROUPS, RETREATS, AND THIRD-PARTY ORGANIZERS
5.1 Facilitation of Retreats: Ownia arranges group stays and retreats on behalf of third-party organizers (“Organizers”). In these cases, Ownia’s responsibility is limited to the logistics of the venue and accommodation procurement.
5.2 Organizer Liability: For group bookings, the Third-Party Organizer (the person or entity leading the retreat) is solely responsible for the content, programming, and safety of the retreat activities. Ownia is not liable for any disputes, injuries, or losses arising from the Organizer’s specific itinerary or leadership.
5.3 Group Agreements: Group and retreat bookings are subject to separate Group Sales and Service Agreements. In the event of a conflict between these Terms and a signed Group Sales Agreement, the terms of the Group Sales Agreement shall prevail.
6.1 Framework: Ownia utilizes a vetting process to measure hotel performance against 12 Impact Pillars derived from the UN Sustainable Development Goals and other general service standards.
6.2 Public Domain Acknowledgment: Ownia acknowledges that the SDGs are a product of the United Nations. Ownia does not claim ownership of the SDGs but does claim exclusive ownership of its own scoring methodology, verification algorithms, and Ownia-branded Sustainability Stamps.
6.3 Third-Party Data: Evaluation is based on hotel-provided data and third-party certifications. Ownia is not a formal auditing body and does not warrant that a hotel’s operations perfectly align with the SDGs at all times.
6.4 Greenwashing Disclaimer: Ownia is not liable for “greenwashing” or misrepresentations made by Member Hotels. You agree that your reliance on sustainability ratings is at your own risk.
7.1 Transaction Role: Ownia may facilitate bookings via direct links or third-party engines. We are not responsible for technical errors, pricing errors, or overbookings.
7.2 Payment Processing: All room payments, taxes, and fees are processed through Ownia using a secure provider (Stripe, Inc.). Ownia does not store your credit card information for bookings. Ownia is not responsible for payment errors, unauthorized charges by the hotel, or refund delays.
7.3 Commissions: You acknowledge that Ownia may receive a commission from Member Hotels for bookings generated through the Site.
7.4 Taxes and Fees: The displayed price for accommodations and travel services may or may not include applicable government taxes, fees, and surcharges imposed by the Member Hotel or relevant taxing authorities. You acknowledge and agree that you are solely responsible for all such taxes, fees, and surcharges that may apply to your booking and use of the Travel Service. Ownia Collection is not responsible for the calculation, collection, or remittance of taxes between you and the Member Hotel.The amount of local taxes can change between the booking date and stay date. If taxes have changed by your stay date, you may be liable to pay taxes at the higher rate.
7.5 Reservation Cancellations and Refunds: All reservation cancellations, changes, and no-show policies are governed exclusively by the specific Rules and Restrictions of the individual Member Hotel or other Travel Service provider (e.g., cancellation deadlines, security deposits, check-in requirements). Ownia Collection acts solely as an agent in facilitating the booking and does not set, control, or override the cancellation or refund policies of Member Hotels. You must refer to the cancellation terms provided at the time of booking confirmation. Ownia is not responsible for any fees, penalties, or losses incurred due to cancellation, and all requests for refunds must be processed through the Member Hotel or its designated booking engine, subject to their terms.
7.6 Currency: Any currency conversion provided is for convenience only and may not reflect real-time market rates or the final amount charged by your bank.
10.1 No Liability for Provider Failure: As a Travel Agent, Ownia is not liable for the failure of Member Hotels to perform as promised. This includes, but is not limited to:
10.2 AI and Communication Errors: Ownia utilizes AI agents and digital tools to facilitate 24/7 service. While we strive for accuracy, Ownia is not liable for errors in pricing, availability, or property descriptions generated by AI tools or communicated during telephone consultations. All bookings are subject to final confirmation by the Member Hotel.
10.3 Exclusion of Damages: to the maximum extent permitted by law, Ownia Collection shall not be liable for any indirect, punitive, incidental, or consequential damages (including personal injury or loss of property) arising from your stay at a Member Hotel.
10.4 Liability Cap: To the maximum extent permitted by law, notwithstanding anything to the contrary contained herein, our liability to you for any damages arising from or related to these terms (for any cause whatsoever and regardless of the form of the action), will at all times be limited to a maximum of $250 USD.
10.5 Travel Insurance: Ownia is not a travel insurance provider. We strongly recommend guests purchase comprehensive insurance to cover cancellations and medical emergencies.
10.6 Limitation on Liability: to the maximum extent permitted by law, in no event shall Ownia (or our suppliers) be liable to you or any third party for any lost profits, lost data, costs of procurement of substitute products, or any indirect, consequential, exemplary, incidental, special or punitive damages arising from or relating to these terms or your use of, or inability to use, the site, even if Ownia has been advised of the possibility of such damages. Access to, and use of, the site is at your own discretion and risk, and you will be solely responsible for any damage to your device or computer system, or loss of data resulting therefrom.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.
You agree to indemnify and hold harmless Ownia Collection from any claims, losses, or legal fees resulting from:
Release. You hereby release and forever discharge Ownia (and our officers, employees, agents, successors, and assigns) from, and hereby waive and relinquish, each and every past, present and future dispute, claim, controversy, demand, right, obligation, liability, action and cause of action of every kind and nature (including personal injuries, death, and property damage), that has arisen or arises directly or indirectly out of, or that relates directly or indirectly to, the Site (including any interactions with, or act or omission of, other Site users or any Third-Party Links & Ads). If you are a California resident, you hereby waive California Civil Code section 1542 in connection with the foregoing, which states: “a general release does not extend to claims which the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor or released party.”
14.1 Trademarks: “Ownia Collection,” “The Best Kind of Travel,” and “Own Your Footprint”, are protected trademarks. All trademarks, logos and service marks (“Marks”) displayed on the Site are our property or the property of other third parties. You are not permitted to use these Marks without our prior written consent or the consent of such third party which may own the Marks. Other logos and product and Ownia names mentioned on our website or these Terms may be the trademarks of their respective owners. We are not responsible for content on websites operated by parties other than us.
14.2 Ownership: You acknowledge that all the intellectual property rights, including copyrights, patents, trade marks, and trade secrets, in the Site and its content are owned by Ownia or Ownia’s suppliers. Neither these Terms (nor your access to the Site) transfers to you or any third party any rights, title or interest in or to such intellectual property rights. Ownia and its suppliers reserve all rights not granted in these Terms. There are no implied licenses granted under these Terms.
14.3 Usage Restrictions: You may not copy, scrape, or reproduce our curated hotel lists or our specific SDG-alignment scores for commercial purposes without prior written consent.
15. FEEDBACK
If you provide Ownia with any feedback or suggestions regarding the Site (“Feedback”), you hereby assign to Ownia all rights in such Feedback and agree that Ownia shall have the right to use and fully exploit such Feedback and related information in any manner it deems appropriate. Ownia will treat any Feedback you provide to Ownia as non-confidential and non-proprietary. You agree that you will not submit to Ownia any information or ideas that you consider to be confidential or proprietary.
16. PROHIBITED USES
You may not use any “robot,” “spider,” or “scraper” to monitor or copy our content. You may not deep-link to any portion of this Site or “mirror” our site on any other platform without express written permission.
17. ACCESS TO THE SITE
17.1 License: Subject to these Terms, Ownia grants you a non-transferable, non-exclusive, revocable, limited license to use and access the Site solely for your own personal, noncommercial use.
17.2 Certain Restrictions: The rights granted to you in these Terms are subject to the following restrictions: (a) you shall not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Site, whether in whole or in part, or any content displayed on the Site; (b) you shall not modify, make derivative works of, disassemble, reverse compile or reverse engineer any part of the Site; (c) you shall not access the Site in order to build a similar or competitive website, product, or service; and (d) except as expressly stated herein, no part of the Site may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means. Unless otherwise indicated, any future release, update, or other addition to functionality of the Site shall be subject to these Terms. All copyright and other proprietary notices on the Site (or on any content displayed on the Site) must be retained on all copies thereof.
Ownia is not liable for service disruptions caused by events beyond our control, including but not limited to: natural disasters, pandemics (e.g., COVID-19 variations), war, terrorism, or government-mandated travel restrictions.
19. MODIFICATION OF TERMS
Ownia Collection reserves the right to modify or amend these Terms at any time by posting the revised Terms on the Site and updating the “Last Revised” date at the top of the document. The revised Terms will be effective immediately upon posting. Your continued use of the Site after the posting of any revised Terms constitutes your acceptance of the new Terms.
Ownia Collection, in its sole discretion, reserves the right to immediately suspend or terminate your access to the Site or any of its services, with or without notice, for any reason, including but not limited to: (a) breach of these Terms, (b) engagement in fraudulent or illegal activity, or (c) violation of our Prohibited Uses policy.
The Site may contain hyperlinks to websites operated by parties other than Ownia Collection, including Member Hotels and third-party booking engines. Such hyperlinks are provided for your reference only. Ownia does not control such websites and is not responsible for their content, privacy policies, or any other practices. Our inclusion of hyperlinks does not imply any endorsement of the material on such websites or any association with their operators.
The Site is based in the United States. Ownia Collection makes no representation that the services are appropriate or available for use in locations outside of the United States. Accessing the Site from territories where the content is illegal is prohibited. If you access the services from other locations, you do so on your own initiative and are responsible for compliance with local laws.
23.1 Governing Law: These Terms are governed by the laws of Delaware, USA.
23.2 Mandatory Arbitration: Any dispute shall be settled by confidential, binding arbitration in the state of Delaware, USA. You waive your right to a jury trial or to participate in a class-action lawsuit.
23.3 Governing Language: The governing language for these Terms is English. Any translation provided is for convenience only, and in the event of any conflict or ambiguity between the English version and a translation, the English version shall control.
We may, and you may not, assign, subcontract or delegate rights, duties or obligations under these Terms. However, we will not do so in such a way as to reduce any rights or guarantees you have under these Terms.
25. THIRD-PARTY RIGHTS
Save as expressly stated in these Terms we do not intend any part of these Terms to be enforceable by any person who is not a party to these Terms. No third-party’s consent shall be required for the waiver, variation or termination of any part of these Terms. These Terms do not give rise to any rights under any applicable laws or regulations in relation to rights of third parties to enforce any part of these Terms.
26. SURVIVAL OF OBLIGATIONS
Any provision of these Terms, which expressly, or by its nature, imposes obligations beyond the expiration, or termination of these Terms, shall survive such expiration or termination.
